TERMS & CONDITIONS OF WEBSITE MAINTENANCE PLAN

These terms and conditions govern the Website Maintenance Plan subscription service provided by Lains Creative, Surrey ("Lains Creative," "I," "me," "my"). My contact email is lucy@lainscreative.co.uk. "You" and "your" refers to the client purchasing the plan.

By signing up and completing your first payment, you confirm that you have read, understood, and agree to be bound by these terms. These terms are legally binding whether or not you have read them in full. If you do not agree, please contact me before signing up.

I reserve the right to update these terms at any time. The date at the top of this page will reflect the most recent version. Material changes will be communicated to active clients with at least 30 days' notice.

1. The service
The Website Maintenance Plan provides up to 1-2 hours of design and content update work per calendar month to your Showit website, covering text, price and copy updates, photo and gallery refreshes, seasonal banners and promotions, testimonials, small design tweaks and refinements, and a monthly site health check.

2. Platform requirement
This plan is available exclusively for websites built on Showit. It is your responsibility to confirm your website's platform before signing up. Showit is a third-party platform and any changes to its functionality, pricing, or availability are outside of my control.

3. What's not included
Larger projects, including new page builds, full redesigns, or rebrands, are not covered by this plan and are quoted and agreed separately before any additional work or charge applies. SEO optimisation is not included in this plan. You are responsible for optimising your own website for search, including meta titles, meta descriptions and image alt text, or seeking specialist SEO support separately.

4. Requests exceeding monthly capacity
If a request is likely to exceed that month's allowance, I will let you know before starting. We will either carry it to the following month or agree a separate quote.

5. Unused time
Time not used within a calendar month does not carry over. If you submit no updates in a given month, I will use the time for a general site health check instead.

6. Turnaround
I aim to complete submitted updates within 10 business days. This is a target, not a guaranteed deadline, and may be affected by circumstances outside my control (see clause 18).

7. Fees and payment
The plan costs £70 per month, billed automatically in advance via Stripe. All payments are processed securely through Stripe in GBP; by using Stripe you agree to be bound by Stripe's applicable terms. I do not store your payment details. I reserve the right to update pricing on future billing periods with notice as set out above; changes will not apply retroactively to a period already paid for.

8. Failed payments
If a scheduled payment fails, I will attempt to collect payment again and notify you. Work under the plan may be paused until payment is resolved, and continued non-payment may result in cancellation of the plan.

9. Statutory cancellation rights
Under the Consumer Contracts Regulations 2013, if you are contracting as a consumer you may have the right to cancel within 14 days of signing up. By requesting that work begin within this period, you acknowledge that if the service is fully performed within the 14 days with your consent, this cancellation right is lost; if you cancel before the 14 days are up and before the service is fully performed, you will only be liable for the proportion of service provided up to the point of cancellation. [Recommend a quick legal check on this clause, though removing the minimum term below reduces how much this matters in practice.]

10. Cancellation
There is no minimum term. You may cancel at any time by emailing me. Your plan will remain active until the end of the current calendar month, with no charge taken for the following month.

11. Refunds
Outside of the statutory cancellation right in clause 9, payments already made are non-refundable, including for months in which you submit no update requests, since time is reserved for you regardless of use.

12. Support
I provide email support for questions directly related to your maintenance plan, including general Showit account and subscription queries. Third-party integrations added to your website are used entirely at your own risk. Further services are available separately if a query falls outside what's reasonably covered here.

13. Access to your website
You agree to provide the access (such as Showit login credentials) required to carry out updates. This access is used solely for the purposes of this agreement.

14. Your content and legal responsibility
You are solely responsible for ensuring that any content, images, text or branding you ask me to add complies with copyright law and applicable regulations, including that you own or hold a valid licence for any images supplied. I am not responsible for legal issues arising from content you ask me to publish.

15. Use of AI tools
I may use AI-assisted tools as part of delivering this service, for example for copy suggestions or image editing; all work is reviewed by me before publishing to your website. If you supply content that has been generated using AI, you are responsible for ensuring it complies with applicable law and any relevant third-party rights.

16. Ownership
Your website and its content remain your property throughout and after this agreement. I retain the right to feature completed updates in my portfolio and marketing materials unless you request otherwise in writing.

17. No guarantee of results
This plan does not guarantee website traffic, enquiries, or business growth. Results depend on your content, marketing, audience, and other factors outside my control.

18. Force majeure
I will not be held liable for any failure or delay in providing the service where this results from circumstances beyond my reasonable control, including platform outages, internet disruptions, or other technical failures.

19. Limitation of liability and indemnification
I will carry out all work with reasonable skill and care. I am not liable for any indirect or consequential loss, including loss of business, revenue, or data. My total liability under this agreement is limited to fees paid in the 3 months preceding any claim. You agree to indemnify and hold Lains Creative harmless from claims, losses, or damages arising from your use of the service or content you ask me to publish.

20. Chargebacks
You agree to contact me at lucy@lainscreative.co.uk to attempt to resolve any issue before raising a dispute or chargeback with your bank or card provider. In the event of a chargeback, I reserve the right to provide evidence of your agreement to these terms and the work carried out to the relevant financial institution.

21. Termination for breach
I reserve the right to terminate this plan, including for non-payment or misuse of access granted under clause 13, with notice where reasonably practicable.

22. Reviews and testimonials
I may invite you to share a review or testimonial. By submitting one, you grant Lains Creative permission to use it for marketing purposes, including on my website and social channels.

23. Age
You must be at least 18 years old to sign up for this plan.

24. Privacy
Your personal data is handled in accordance with my Privacy Policy at https://lainscreative.co.uk/privacy-policy.

25. Governing law and disputes
These terms are governed by the laws of England & Wales. In the event of a dispute, please contact me in the first instance so we can work together to find a resolution. Where a resolution cannot be reached, the matter will be referred to mediation before any legal proceedings are commenced.

26. Severability
If any part of these terms is found to be unenforceable, the remaining clauses will continue to apply in full.
